Dean Robert Rasmussen was quoted about General Motors bondholders lacking a voice in the company’s reorganization. Because GM has chosen to use section 363 of the bankruptcy code, smaller bondholders won’t have a chance to vote down a GM reorganization plan, as they would under Chapter 11 bankruptcy. “The basic right bondholders have is to say they won’t approve a reorganization,” Rasmussen said. “By going the 363 route, it takes away that ability to make a procedural objection.”
